Basic terms
- Store/Service – the online service available at genxone.eu/sklep, through which the Consumer can purchase the Service. Laboratory tests constituting the provision of the Service are performed by the Service Provider under the terms set forth in these Terms and Conditions and applicable regulations.
- Consumer – a natural person with full legal capacity who uses the Store in accordance with the terms set forth in these Terms and Conditions to purchase the Service for their own or someone else’s use.
- Beneficiary (Patient) – a person entitled to use the Service acquired through a purchase made by the Consumer in the Store. The Beneficiary may be the Consumer or another person indicated in the test order form.
- Shopping Cart – a Store feature that allows the display of Services selected by the Consumer for purchase. This is also where Order data can be entered and changed, including the quantity of Services purchased, shipping information, invoice details, and payment method.
- Electronic Payments – an electronic payment system accepted by the Website, enabling quick payment for Services purchased in the Store.
- Service – a service provided by the Molecular Diagnostics Laboratory, available to Store Beneficiaries, aimed at preventing, preserving, saving, restoring, or improving health. The Service requires the purchase of the appropriate collection kit in the Store. A detailed description of the Service includes a description of the pathogens detected in the test, the indications for the test, and the technology used in the test.
- Order – a declaration of intent by the Consumer to purchase the Service in the Store, expressed by placing it in the Cart and proceeding to the next step – “Buy and Pay.” Each Order receives an identifier that allows for the completion of the test at the Molecular Diagnostics Laboratory.
- Collection Kit – a disposable kit for self-collection of a biological sample. The kit is an integral part of the Service and cannot be completed without it. The kit, packaged in a folder, contains: a test tube, a swab, necessary accessories, and further instructions for sample preparation. The kit also includes a return envelope and a shipping note for returning the sample for testing.
- Molecular Diagnostics Laboratory – the Service Provider’s laboratory providing the Services.
GENERAL PROVISION
- These Terms and Conditions define: the rules for using the Store, the conditions for placing Orders for Services available in the Store, the scope of the Consumer’s obligations related to payments and activities necessary to fulfill the Order, the Consumer’s rights in the process of concluding distance contracts, and the rules for submitting and handling complaints.
- These Terms and Conditions have been prepared based on the following provisions:
a) the Act of 18 July 2002 on the provision of services by electronic means;
b) the Act of 23 April 1964 – the Civil Code;
c) Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR);
d) the Act of 30 May 2014 on consumer rights. - To use the Store’s functionality, the Consumer must have a device with internet access and an up-to-date web browser (Chrome, Mozilla Firefox, Microsoft Edge, Internet Explorer, Opera, Safari, or other). Access to an email account and a telephone are required to complete the Order.
- By using the Website, the Consumer undertakes, even if they do not intend to purchase the Service, to refrain from any activity that may negatively impact the proper functioning of the Website. Interfering with the content, technical elements, or any other elements of the Website, as well as conducting commercial or promotional activities on the Website, is prohibited. Copying elements of the Store or using them in a manner not specified in these Terms and Conditions is prohibited.
INFORMATION ABOUT THE SERVICES OFFERED AND THEIR PRICES
- Consumers can purchase Services in the Store. Service purchases are made online, and the Services are performed at the genXone SA Molecular Diagnostics Laboratory.
- The information about the Services provided on the Store’s website constitutes an invitation to enter into a contract within the meaning of Article 71 of the Civil Code.
- The prices of the Services listed on the Store’s website are given in Polish zloty and are gross prices. Services, as medical services, are exempt from VAT. The total cost of the Order (i.e., the sum of the prices of all ordered Services and shipping costs) is known to the Consumer before finalizing the Order and is indicated in the Shopping Cart.
- The Service Provider reserves the right to make ongoing changes to the Terms and Conditions or the content published in the Store, in particular to the prices of the Services, the scope of the Services provided, or the description of the Services. Changes to the Terms and Conditions or the content published in the Store do not apply to Orders in progress.
- The price listed in the Store for each Service is binding at the time the Consumer places an Order.
- Payments made in the Store are settled via traditional bank transfers or online payments.
- Ordering a Service means ordering a Collection Kit, which should be used by the Beneficiary in accordance with the attached instructions. The sample collected in this manner should be returned to the Service Provider’s office. Without this step, the Service cannot be completed, to which the Consumer irrevocably consents. Improper collection of biological material or its improper protection prevents diagnostic testing and requires the ordering of a new Collection Kit, including the coverage of shipping costs.
- Orders and Services are only fulfilled within Poland.
CONDITIONS FOR PLACING AN ORDER
- Orders can be placed 7 days a week, 24 hours a day, excluding technical interruptions and other unforeseen disruptions.
- The Store is not responsible for any technical difficulties (poor internet connection, device failure, etc.) at the time the Consumer places the Order.
- To place an Order, please follow the steps below:
- Select the Service you wish to order by clicking the “Add to basket” button.
- You can continue browsing the Store’s offerings and select other Services to order in a similar manner.
- To return to the basket view, click the icon of cart in top menu.
- In the basket panel, check the Services you have ordered, their quantity, and price. You can change the quantity or delete unwanted Services. Confirm any changes by clicking the “Update cart” button.
- If the Services are ordered for more than one person, select the appropriate number of patients.
- In the field next to the “Apply Coupon” button, enter the promotional coupon code entitling you to a discount, and then confirm by clicking the “Apply Coupon” button – if you are eligible for the discount.
- Select the delivery method (delivery options and costs can be checked on the “Information about offered services” page).
- If the Cart contents are as expected, select “Proceed to checkout.”
- Complete the fields in the form, providing the Consumer’s true details: first name, last name, address, telephone number, and email address. If the Order is to be shipped to a different address, select the “Deliver to another address” option and complete the fields below. If the Buyer is a company, put the name of Company and the VAT number.
- Select the delivery method
- Select the payment option: bank transfer or online payment – Przelewy24 online payment system.
- Read and accept the Terms and Conditions by checking the appropriate box.
- Click “I buy & pay” – this constitutes placing the Order with the obligation to pay.
- After placing a valid Order, the Consumer receives feedback via e-mail to the e-mail address indicated in the Order.

CONDITIONS OF SERVICE PROVISION
- For the Service to be completed, payment must be made:
- Payment by bank transfer – payment must be made on the bank’s website, providing the necessary transfer details, including the Service Provider’s name and account number, the amount, and the Order number.
- Online payments: PayPro SA – click “Buy and pay” and make the payment via the PayPro SA system. Payment of the Order fee constitutes the conclusion of a contract.
- Payment by payment card – the payment card operator is PayPro SA Agent Rozliczeniowy, ul. Kanclerska 15, 60-327 Poznań, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court for Poznań Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register, under KRS number 0000347935, Tax Identification Number (NIP) 7792369887, and National Business Registry Number (REGON) 301345068.
2. After paying for the Order, the Order item, i.e., the selected number of collection kits, will be shipped to the address provided in the form.After preparing the sample according to the instructions included in the Collection Kit, prepare a return shipment and send it to the Service Provider’s office. If the transport folder containing the Collection Kit is damaged, place the sample in a different box, then pack it in the enclosed courier envelope and follow the instructions in the instructions.
3. If the information provided in the form raises any questions, the Store staff will attempt to clarify the matter by phone or email. The Order may be canceled by the Store staff, and the Consumer will be notified by email, explaining the reason for the cancellation.
4. Order cancellation may also occur if payment is not received within 3 days of placing the Order. In such a case, the Order cancellation will be preceded by an email reminder regarding payment and the consequences of non-payment. Cancellation of the order does not in any way restrict the possibility of placing a new order.
5. The order cannot be fulfilled in the following cases:
- Providing insufficient or false data by the Consumer,
- Incorrect collection of biological material (usually too large a quantity) – in this case, a new biological material collection kit must be ordered and shipping costs must be covered (the websites where the purchase should be made are: https://genxone.eu/produkt/dodatkowy-zestaw/ for foodborne infections and https://genxone.eu/produkt/dodatkowy-zestaw-pobraniowy-infekcje-intymne/ for intimate infections).
- The order was placed incorrectly (e.g., when the Consumer did not click “I buy & pay”),
- When contacting the Consumer by phone or email is impossible, and, for example, data verification or consent to a change in the shipping date is necessary.
6. The Service Provider undertakes to perform the Service in accordance with the Order and without defects.
7. If the Service cannot be performed due to the Service Provider’s fault, the Consumer will be informed immediately. In such a situation, the Consumer will decide to cancel the Order or agree to a delay in the Service completion date.
8. If laboratory test is not possible due to the quality of the biological material, resulting in a non-diagnostic result, the Store staff will contact the Consumer to determine further steps. Issuing a non-diagnostic result will terminate the Order.
CANCELLATION OF THE ORDER AND WITHDRAWAL FROM THE CONTRACT
- A Consumer who has placed an Order has the right to withdraw from a distance contract within 14 days without providing any reason. The 14-day period begins when the Order item reaches the delivery address indicated in the Order.
- Notwithstanding the provisions of point 1 above, the Order may also be cancelled if it has not yet been shipped to the Consumer.
- To exercise the right of withdrawal, complete the Withdrawal Form available on the Store’s website and send it electronically to: bok@genxone.eu or by post to:

62-002 Złotniki - The declaration of withdrawal from the contract may be submitted in another written form, convenient for the Consumer.
- After withdrawing from the contract, the Consumer is obligated to return the Sample Collection Kit in its unaltered condition at their own expense. The Service Provider does not accept unconfirmed Cash on Delivery shipments and is not responsible for the costs associated with such shipments.
- In the event of withdrawal from the contract, the Service Provider will refund the Consumer’s payment, including the cost of delivery of the Sample Collection Kit, equal to the cheapest shipping option available. If the withdrawal occurs while the Order is still being processed, the Service Provider will refund the full amount paid by the Consumer.
- The refund will be made to the bank account indicated in the declaration of withdrawal from the contract, immediately after the Service Provider receives the returned collection kit, and no later than 14 days from the date of receipt of the declaration of withdrawal.
- If the value of the returned collection kit decreases (e.g., missing gloves or a test tube, or damaged tube packaging), the Consumer’s refund will be reduced by the value of the collection kit.
- The Consumer cannot withdraw from the contract if:
- The collection kit has been destroyed,
- A sample has been sent to the Service Provider, or the Service has been completed,
- A swab has been collected.
COMPLAINTS
- Complaints can be submitted via:
- Electronically to the email address: bok@genxone.eu
- In writing to the previously provided address of genXone S.A.
- The complaint should include the Consumer’s details, the Beneficiary’s details (if different), and a concise description of the concerns.
- If the complaint requires further clarification, the Store’s staff will request details regarding the Order from the Consumer.
- The Service Provider will review the complaint within a maximum of 14 days from the date of its receipt.
PERSONAL DATA
- Personal data provided by the Consumer in the Store is processed by genXone S.A. with its registered office at ul. Kobaltowa 6, 62-002 Złotniki, (the data controller, hereinafter referred to as the Controller). The Controller has appointed a Data Protection Officer (hereinafter referred to as the DPO). - Providing data by the Consumer constitutes a declaration that the data is true and constitutes their personal data.
- Providing personal data by the Consumer is voluntary, but it is necessary to complete the Ordering processes described in the following sections: Terms of Order Placement, Terms of Service Delivery, Cancellation of Order and Withdrawal from the Contract, and Complaints. The Controller processes personal data for the purpose of concluding and executing sales contracts for Services purchased in the Store with the Consumer.
- If the Customer consents, the Controller also processes personal data for marketing purposes.
- The Customer has the right to access, correct, and delete their personal data. Consumers may express their wish to exercise their rights in writing (to the above-mentioned address of the Administrator or DPO), by email (office@gemxone.eu or rodo@genxone.eu), or on the Store’s website in the My Account tab after logging in.
- Information regarding the processing of personal data, including the rights of data owners required by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR), can be found in the Privacy Policy at the following link: https://genxone.eu/privacy-policy/
FINAL PROVISIONS
- The law applicable to the contract between the Consumer and the Service Provider, the subject of which is the Service provided by the Service Provider under the terms and conditions specified in the Terms and Conditions, is Polish law. Any disputes related to the Service provided by the Service Provider will be resolved by the competent Polish common courts. Consumers who are consumers have the option of using an out-of-court complaint resolution and redress mechanism before the Permanent Consumer Arbitration Court at the Provincial Inspectorate of Trade Inspection in Poznań. Information on how to access the aforementioned dispute resolution procedures can be found at the following address: http://www.uokik.gov.pl, in the “Resolution of consumer disputes” tab. Consumers also have the option of using the EU ODR online platform, available at: http://ec.europa.eu/consumers/odr/. If the Consumer consents to out-of-court consumer dispute resolution (ADR), the authorized entities can be found in the register: https://uokik.gov.pl/rejestr_podmiot_uprawnionych.php
- Consumer use of the Website’s functionalities is free of charge.
- In matters not regulated in the Terms and Conditions, generally applicable law shall apply.
- Changes to the Terms and Conditions may occur, in particular, as a result of changes in legal regulations, software changes, or changes to the Service profile. The Service Provider will inform about changes to the Terms and Conditions via a notice in the Store. Changes to the Terms and Conditions do not affect the fulfillment of Orders placed before the amendment.
- Reselling Services is prohibited.
- The Terms and Conditions come into effect on October 19, 2021. Last updated: May 20, 2026, in connection with the share capital increase.
